Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Picksmith (“we”, “us”, “our”) for use of picksmith.co, subscriber accounts, and related email delivery. By registering, subscribing, or using the service, you agree to these Terms and our Privacy Policy and Refund Policy.

1. Nature of the service (important)

Picksmith is a subscription-based digital publication that provides general informational and educational research about publicly listed companies. Content is written in an editorial, newsletter format for a general audience.

Picksmith does not:

• Execute trades, hold customer funds, or manage investment portfolios;
• Provide personalised investment, legal, tax, accounting, or financial advice;
• Offer automated trading signals, copy-trading, algorithmic buy/sell alerts, or instructions to enter or exit specific securities;
• Act as a broker-dealer, investment adviser, commodity trading adviser, or financial planner; and
• Guarantee any investment outcome, return, or performance.

Any company names, scores, charts, or commentary are opinion and analysis for learning purposes only. You must make your own independent decisions and, where appropriate, consult licensed professionals before investing.

2. Not investment advice

Nothing on Picksmith — including weekly issues, scores, archives, emails, or sample content — should be construed as a recommendation or solicitation to buy, sell, or hold any security, or as tailored advice for your circumstances. We do not take into account your objectives, financial situation, risk tolerance, or needs. Past performance discussed in our research is not indicative of future results.

Picksmith is not registered with the U.S. Securities and Exchange Commission or any state securities regulator as a broker-dealer or investment adviser. If you require regulated advice, you should seek a qualified professional in your jurisdiction.

3. Accounts and eligibility

• You must be at least 18 years old (or the age of majority where you live).
• You must provide accurate account information and keep your credentials secure.
• Access is for one individual only. You may not share logins or redistribute subscriber content.
• You may not use the service if doing so would violate applicable law in your location.

4. Free trial and subscription

• New accounts may access a limited number of Sunday research editions at no charge (“free trial”) as described on the site at signup.
• Continued access to the full archive and new editions requires a paid subscription, currently $14.99 USD per month, billed in advance until cancelled.
• We may change pricing for new subscribers; existing subscribers will be notified before a price change applies on renewal.
• You may cancel anytime from your Account page. Cancellation takes effect at the end of the current paid billing period; access continues until then.

Your subscription fee pays for access to digital editorial content only — not for trading services, portfolio management, or personalised advice.

5. Payments and PayPal

Paid subscriptions are sold by Picksmith and processed through PayPal as our payment provider. PayPal handles secure checkout and recurring billing for your subscription. Your PayPal receipt shows the charge; Picksmith is the seller of the digital subscription service.

• We do not store your full payment card or PayPal login credentials on our servers.
• For payment, invoice, or billing questions, contact [email protected] with your account email and PayPal transaction reference.
• Refund rules are set out in our Refund Policy.

6. Acceptable use

You agree not to:

• Scrape, bulk-download, mirror, or resell our content or data;
• Share accounts, bypass paywalls, or interfere with the service or its security;
• Represent our general research as personalised advice to others;
• Use the service for unlawful, fraudulent, or abusive purposes.

7. Intellectual property

Reports, branding, layout, and other materials are owned by Picksmith or licensors. Your subscription grants a personal, non-exclusive, non-transferable licence to view content while your account is active and in good standing. No other rights are granted.

8. Disclaimers

The service and all content are provided “as is” and “as available”. We do not warrant accuracy, completeness, timeliness, or fitness for a particular purpose. Market data and third-party information may contain errors or delays.

To the fullest extent permitted by law, we disclaim all warranties, express or implied. You use Picksmith at your own risk.

9. Limitation of liability

To the fullest extent permitted by law, Picksmith and its operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading or investment losses, lost profits, or lost data arising from your use of (or inability to use) the service or reliance on any content. Our total liability for any claim relating to the service is limited to the greater of (a) amounts you paid for the subscription in the twelve months before the claim, or (b) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

10. Indemnity

You agree to indemnify and hold harmless Picksmith from claims arising out of your misuse of the service, violation of these Terms, or investment or trading decisions you make.

11. Changes and termination

We may update these Terms or the service. Material changes will be posted on this page with an updated effective date. We may suspend or terminate access for breach of these Terms. You may stop using the service at any time.

12. Governing law

These Terms are governed by the laws of the United States and the State in which Picksmith operates, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply.
